Montréal (Québec) – The Board of Directors of the Sport Dispute Resolution Centre of Canada (SDRCC) has adopted a new Canadian Sport Dispute Resolution Code (Code) which will come into effect on January 1, 2021.
Following recent consultations with the sport and the legal communities, the SDRCC proceeded to amend the Code in order to clarify its procedures and to improve its rules and processes. The most significant changes led to the creation of four different divisions, including the Safeguarding Tribunal specialized in hearings pertaining to conduct rule violations, as well as the ordinary, doping and appeal divisions. In addition, the Code grants additional powers to the jurisdictional arbitrator, redefines the scope of review of the arbitrator, and provides for a broader access to Resolution Facilitation and to other services for a fee, offered more frequently by the SDRCC. Of course, significant amendments were also mandated by the coming into force of the 2021 Canadian Anti-Doping Program.
